END-OF-SERVICE GRATUITY, ORDER TO PAY 9,900 DINARS TO AN EXPATRIATE

Kuwait City: The Constitutional Court has ruled that the decision taken at the April 23, 2018 meeting of the Civil Service Council was unconstitutional. The court ruled that the payment of end-of-service gratuity to non-Kuwaiti employees should not be delayed. The case is being heard by an Egyptian expatriate. 


Since 2009 he has been working as a Senior Engineering Specialist in the Expert Division of the Ministry of Justice. On April 3, 2018, he applied to have his contract terminated and receive an end-of-service gratuity. He was to receive about 9900 dinars. However, the Civil Service Commission refused to provide it. The Civil Service Council has stated that end-of-service gratuity will be paid to non-Kuwaiti employees only if they submit a notice to leave the country.
