SICK LEAVE WITHOUT DOCTOR'S NOTE IS FROWNED UPON BY CSC

Kuwait City: The Civil Service Commission (CSC) has written to the Ministry of Health, requesting a legal opinion on the establishment of a service to create sick leave without medical guidance, so that employees can use the platform to get sick leave without having to attend a health centre.


In his response to the ministry, the Assistant Undersecretary for Legal Affairs at the CSC stated that the Ministry of Health's proposal is discretionary to the employer, according to the proposed procedure, who has the right to accept or reject, as this is a legal violation and contradicts the nature of sick leave. He explained that the proposal requires the CSC to amend Decision No. 39 of 2006, because this decision requires sick leave to be granted by primary health care centres, and thus granting it without medical approval according to the proposed procedure necessitates presenting the issue to the CSC, and no action can be taken without CSC approval.
