Kuwait plans unified screening of companies for government tenders

Kuwait is moving to establish a unified mechanism to prevent companies facing security restrictions or serious concerns linked to fraud and other criminal acts from securing government tenders and contracts. The proposed framework aims to protect public funds, safeguard the integrity of government procurement and prevent risks that could disrupt public services.

The Ministry of Commerce and Industry will coordinate with the ministries of Interior and Finance, the Fatwa and Legislation Department, Kuwait Municipality, the Central Agency for Public Tenders and the Public Authority for Manpower to develop the proposed controls. The mechanism is intended to ensure that government entities follow consistent procedures to identify restricted companies and verify their eligibility before awarding contracts.

The proposed rules will define which security observations warrant exclusion, how long restrictions should remain in force and the conditions under which they may be lifted. Authorities will also examine whether restrictions should apply only to the company concerned or extend to its partners, managers, board members, beneficial owners and authorized signatories. This is intended to prevent restricted businesses from bypassing controls by establishing new companies under different names.

The framework will also establish procedures for updating company records, notifying government agencies of changes in status and identifying the authority responsible for maintaining and verifying the relevant list. Legal safeguards will be considered to ensure transparent and consistent implementation while protecting public funds and the rights of affected companies. The relevant authorities are expected to submit their recommendations to the Cabinet for consideration before the proposed mechanism is implemented.
