Kuwait’s Administrative Court has upheld the Public Authority for Housing Welfare’s decision to reclaim government houses in East Taima, ruling that residents do not have a permanent legal right to remain in government-owned properties without a valid legal basis.
The court said occupancy or use of government housing is a right subject to the conditions and regulations established by law and does not create independent ownership rights over the property. It also affirmed that the Housing Welfare Authority has the legal power to provide government homes through rental arrangements or specified usage permissions. Since the disputed properties are considered public assets, the court said they can only be managed in accordance with legal authority.
The ruling also referred to Legislative Decree No. 83 of 2025, which repealed the relevant provision of Article 29 of the Housing Care Law. The court found that the legal basis relied upon by the claimant to remain in the government property was no longer valid and dismissed the case. The ruling means the affected residents in East Taima will have to vacate the government homes.
