THE PROCESS OF MARITIAL AUTHENTICATION FOR "PAPERS ISSUED OUTSIDE OF KUWAIT"

Kuwait City: Dr. Fahad Al-Dhaen, Director of the Ministry of Justice's Legal Certification Department, stated that the procedure of marital authentication is for marriage certificates issued outside of Kuwait and is required if both couples are Kuwaitis or one of them is. The consent of the Ministry of Foreign Affairs is sufficient for non-Kuwaitis, according to Aljarida daily. Dr. Al-Dhaen said in a press statement about a circular that created problems in this respect that the circular was sent with a typo, since the term "unless" was not included. It was agreed that even if a judicial judgement is issued, it will not be enforced. 


On the contrary, legal judgements are enforceable, respected, and applied. The problem was resolved by rectifying the error, releasing a new circular, and withdrawing the original one. The second paragraph clarified this meaning further, and the revised judgement was given as a result. Unfortunately, the first circular implied that it is a restriction on Bedoun inhabitants.

On the contrary, this makes things easier for them. Marriage within Kuwait remains the same for Kuwaitis, non-Kuwaitis, and Bedoun residents. Its methods have not changed. It is worth noting that the Ministry of Justice's Department of Legal Certification published a circular on November 28 stating that marital authentication was not carried out by a judicial judgement for Bedoun inhabitants unless one of the parties to the marriage is a Kuwaiti. 

This caused widespread outrage on social media, prompting the department to withdraw the circular and publish another with greater clarity. According to the new circular, authorities, heads of departments and external offices, as well as their notaries in service centres, must commit to not issue marital authentication documents under an overseas marriage certificate unless one or both parties are Kuwaitis.
