KUWAITI CITIZENSHIP REMOVAL FOR EXPAT WIDOWS AND DIVORCEES IS BEING INVESTIGATED

Kuwait City: The Fatwa and Legislation Department is currently investigating the process of withdrawing Kuwaiti citizenship from non-Kuwaiti women who obtained it in accordance with Article 8 of the Kuwaiti nationality decree after marrying Kuwaiti citizens, but then married non-Kuwaitis following divorce or the death of their Kuwaiti husbands. 


The department initiated this investigation after the Interior and Defense Committee of the Parliament referred a note to the Ministry of Interior demanding information on the constitutionality of this action. According to the memorandum, the Parliament's Interior and Defense Committee requested information from the Ministry of Interior on the feasibility of adding a new paragraph to the draught law concerning the naturalisation of Kuwaiti women. The new paragraph reads as follows: "It provides for the removal of Kuwaiti nationality from foreign women who gained it based on Article 8 of Amiri decree No. 15/1959 on Kuwaiti nationality and whose marital relationship ended in divorce or death and they married non-Kuwaitis." This is based on the debate held during the committee meeting. 

The committee expressed its desire to learn the Ministry of Interior's point of view after receiving the Fatwa and Legislation Department's opinions in accordance with the procedures followed, so that the committee could make a decision after learning the constitutionality of this addendum in accordance with all of the opinions presented to it. "The General Department of Legal Affairs has addressed the Fatwa and Legislation Department to respond to what was stated in this question so that the committee can take its decision after knowing the constitutionality of this addition, and you will be informed of the developments in this regard," the Ministry of Interior responded to the memo.
