FATWA APPROVING ONLINE MARRIAGE

Kuwait City: Based on the Ministry of Justice's vote on the legality of marriage using contemporary means of communication via the Internet, the Fatwa Authority of the Ministry of Awqaf and Islamic Affairs issued a fatwa.

According to the fatwa, the ministry submitted a referendum to the Fatwa Authority asking whether it is acceptable to conclude and record marriage contracts using contemporary electronic methods. The referendum was submitted by the Assistant Undersecretary of the Ministry of Justice for Family Affairs and Arbitration.

The Sharia Documentation Department studied the draught conclusion and documentation of marriage contracts made using contemporary electronic methods (the Internet) at the Ministry of Justice through an approved electronic system that allows the interested parties to submit their identification documents and other paperwork required for the conclusion of marriage contracts, as well as making it possible for the notary (the legally authorised person) through this programme to address and discuss any issues that may arise. 

Since the parties to the contract and the witnesses can participate in one session in terms of time, judgement, and location even though they are physically separated because they hear the speech at the same time, the offer comes from the guardian and the husband accepts it. The guardian and husband are simultaneously heard by and seen by the witnesses.
