DELHI HIGH COURT DIRECTS GOVT TO TAKE IMMEDIATE ACTION TO PAY COMPENDATION TO EXPAT FAMILIES AFFECTED BY COVID

Kuwait City: Delhi High Court directs govt to make an immediate decision for compensation to the families of expatriates who died due to covid. Advocate Jose Abraham, Global President, Pravasi Legal Cell, has filed a public interest litigation in this regard. The verdict was passed by a division bench comprising Justice Jyoti Singh headed by Delhi Chief Justice DN Patel. Adv. Sreevignesh attended.


Provide financial assistance to the families of expatriates who died due to covid in the petition filed by the Pravasi Legal Cell, issue of financial assistance from the PM Care Fund to the Indian children of expatriates whose parents died abroad due to the covid epidemic. In the first week of July, the Supreme Court ruled that compensation should also be paid to the families of expatriates who died of covid. . The petition was filed by Pravasi Legal Cell Global President Adv Jose Abraham and Global Spokesman Babu Francis. The Pravasi Legal Cell has approached the Delhi High Court and now the High Court has issued a judgment as the Supreme Court has delayed the decision in favor of the Pravasi despite the expiry of the time limit initially allowed by the Supreme Court.

The Government has an obligation to ensure the fundamental rights of citizens under the Constitution of India, Expatriate Indian expatriates living outside India have the same right to government welfare schemes as citizens in India. The exclusion of expatriates from any government scheme may be considered a violation of Article 14 of the Constitution, "Equality"; The petitioner contended that as expatriates are also entitled to ordinary citizenship in government schemes, the families of Indian expatriates living abroad who have lost their lives due to covid should also be considered for the benefit and that any discrimination in the case of expatriates would be unconstitutional. The judgment of the High Court has come considering the importance of the matter. Therefore, the decision of the Central Government is expected soon, said Pravasi Legal Cell Global President Adv. Jose Abraham and Global Spokesman Babu Francis said in press release.
